Khaja Moizuddin Murder Case: Court Rejects Bail Plea of Conspiracy Accused; Son Khaja Farhan Vows to Oppose Future Bail Petitions

A court on July 24 rejected the bail petitions filed by several accused in the Khaja Moizuddin murder case. Following the court’s decision, Khaja Farhan, son of the slain advocate Khaja Moizuddin, expressed happiness over the order and said his legal team, along with the Public Prosecutor, successfully opposed the bail pleas. He also stated that his family would continue to oppose any future bail petitions, including those that may be filed before the High Court or the Supreme Court.

Court Rejects Bail Petitions of Conspiracy Accused

Speaking to the media after the court order, Khaja Farhan said that all the accused whose names were mentioned in the alleged criminal conspiracy had filed bail petitions.

According to him:

• The Public Prosecutor filed a counter on behalf of the police.
• His legal team also presented arguments before the court.
• After hearing both sides, the court dismissed the bail petitions of the accused involved in the alleged criminal conspiracy.

Khaja Farhan described it as the first bail petition and said the accused may file second or third bail petitions in the future or approach the High Court.

He said his legal team would remain prepared for every legal challenge.

Previous Bail Plea of Mahboob Alam Khan Also Rejected

Khaja Farhan recalled that a few weeks ago, the court had also dismissed the bail petition of murder accused No. 2, Mahboob Alam Khan.

He further stated that the bail hearing of murder accused No. 1, Mujahid Alam Khan, took place on July 24, and arguments from his side would continue on Tuesday next week, after which the court is expected to reserve its orders.

He also claimed that Mahboob Alam Khan has filed a second bail petition, which his legal team will oppose by filing counters and implead petitions.

Khaja Farhan Repeats Allegations Over Waqf Property Dispute

During the media interaction, Khaja Farhan alleged that his father, Advocate Khaja Moizuddin, was murdered on May 23 while he was going for a morning walk.

He alleged that Mahboob Alam Khan and Mujahid Alam Khan were involved in the murder over a long-running dispute relating to Waqf properties, including:

• Anwar-ul-Uloom College
• Madrasa Aiza Waqf
• Land on which Nawab Shah Alam Khan Engineering College was built
• Mumtaz College Waqf

Khaja Farhan alleged that members of the Alam Khan family had illegally occupied these Waqf properties and described them as a “Waqf mafia.”

He further alleged that his father had been fighting legal cases against them for 15 years, and that the murder was carried out after a planned criminal conspiracy.

Claims of Planned Conspiracy and Contract Killing

Khaja Farhan alleged that the murder was carried out after a carefully planned conspiracy and claimed that his father was killed through hired assailants.

He said his family would continue to pursue the case legally and oppose every bail petition.

He also stated that, if necessary, they would contest the matter before the High Court and the Supreme Court.

Search Continues for Two Absconding Accused

Khaja Farhan claimed that accused No. 6 Munir and accused No. 7 Chawush, whom he described as childhood friends of Mujahid Alam Khan from Barkatpura, are still absconding.

According to him, police have informed him that special teams have been formed to trace them.

He alleged that the two accused have:

• Farmhouses in Barkatpura
• Farmhouses in Bengaluru
• A house in Ooty
• Other properties in different locations

He expressed hope that police would soon trace the two accused and produce them before the court for remand.

Pending High Court Writ Petitions Mentioned

Khaja Farhan also referred to pending writ petitions in the High Court from 2014, 2016, and 2017.

He said that when IPS officer Sheikh Mohammed Iqbal took direct management of Anwar-ul-Uloom College following complaints made by his father, criminal complaints were registered against Mahboob Alam Khan with the CCS, and crime numbers were also registered.

According to Khaja Farhan, Mahboob Alam Khan later obtained a stay order from the High Court.

He said fresh applications would be filed seeking restoration of direct management, claiming that the institution is a Waqf property that had allegedly been converted into private ownership.

Allegations Regarding Financial Transactions

Khaja Farhan further alleged that:

• Munir and Chawush were involved in handling money.
• During 2023 and 2024, they allegedly met him along with Mujahid Alam Khan during settlement discussions.
• They allegedly attempted to persuade and threaten his family to settle the dispute.

He also named Nizam and Abid, identified by him as accused Nos. 11 and 12, alleging that they worked in the accounts section of Anwar-ul-Uloom College and collected fees from students.

Khaja Farhan alleged that they knew where the money was being used and claimed that they were arrested in connection with the case because of this alleged role.

These allegations were made by Khaja Farhan during his media interaction and remain subject to investigation and judicial proceedings.
