Future coupons case : SC extends stay till Sep 20 on CCI’s Rs 200 cr penalty on Amazon

A two-judge Bench of the Supreme Court, headed by Justice A S Bopanna and also comprising Justice M M Sundresh, extended the stay till September 20.

New Delhi: The Supreme Court on Monday ordered further granting relief to Amazon Investment Holdings LLC, and extended the stay till September 20 on the Rs 200 crore penalty imposed by the Competition Commission of India (CCI) on the e-commerce giant in the Future coupons case.

A two-judge Bench of the Supreme Court, headed by Justice A S Bopanna and also comprising Justice M M Sundresh, extended the stay till September 20.

“We extend the stay (interim) till September 20,” Justice Bopanna said, and directed that no coercive steps shall be taken in relation to the notice issued by the CCI on April 25 against Amazon.

The regulator, CCI, had imposed a Rs 200 crore penalty on Amazon for failing to notify the shareholder agreement involving Future Retail.

Amazon had moved the Supreme Court challenging this CCI order and sought quashing and appropriate directions and orders in it.

Senior lawyer, Gopal Subramanian, appearing for Amazon group, told the Top Court that the question which arises are actually unique and in this case, what has happened is that a particular section has been applied, Section 3 (A) of the Competition Act which provides a penalty. You would not file (challenge the order) at all, that was the section says.

For the CCI, Senior lawyer and Additional Solicitor General (ASG) N Venkatraman, told the Apex Court that the CCI order was a statutory order. It relied on a contract Arbitration in Singapore, and he sought a deferment of the case.

The Judges agreed, and adjourned the matter to third week of September.
