Wife calling husband dark-skinned constitutes cruelty: Karnataka High Court


Bangalore: The Karnataka High Court recently ruled that a wife’s act of humiliating her husband by calling him dark-skinned constitutes cruelty. The Court observed that the husband’s claims of cruelty were supported by evidence, allowing his plea for divorce.

The Court further noted that the wife’s attempts to distance herself from her husband and falsely accuse him of illicit relationships were also considered cruel.

Justices Alok Aradhe and Anant Ramanath Hegde made this observation while granting the husband’s request for divorce.

The Court was dealing with an appeal against the family court’s decision to dismiss the husband’s plea for marriage dissolution under the Hindu Marriage Act, 1955. The husband had filed for divorce in 2012, citing consistent demeaning based on his skin color by his wife. The Court found no credible evidence to support the wife’s allegations of an extramarital affair and concluded that her accusations were baseless.

The Court also took into account the wife’s pursuit of multiple legal cases against the husband’s family and the lack of communication between the couple. As a result, the Court allowed the husband’s plea for divorce, with Advocate Janardhana G representing the husband and Advocate D Bhuvaneshwari representing the wife.
