Mandatory Reporting of Foreign Nationals Under Immigration and Foreigners Act, 2025
According to the advisory dated 03-06-2026, submission of information relating to foreign nationals is mandatory under the provisions of the Immigration and Foreigners Act, 2025 and the Immigration and Foreigners Rules, 2025.
The advisory applies to:
- House Owners
- Hotels
- Lodges
- Guest Houses
- Homestays
- Educational Institutions
- Universities
- Colleges
- Hospitals
- Other Accommodation Providers
Authorities stated that concerned accommodation providers must also submit information regarding the departure of foreign nationals and preserve such records for a minimum period of one year from the date of submission.
Form-III (Form-C) Mandatory for Accommodation Providers
The advisory states that all House Owners, Hotels, Lodges, Guest Houses, Homestays and other Accommodation Providers are required to submit Form-III (Form-C) online for every foreign national staying at their premises.
This requirement includes:
- Foreign Passport Holders
- OCI Card Holders
- Nepalese Nationals
- Any other foreign national residing or staying in their premises
The particulars must be furnished through the prescribed online portal within 24 hours of the arrival of the foreign national at the premises.
Form-II Mandatory for Educational Institutions
The advisory further states that all Universities, Colleges, Schools, Educational Institutions and Training Institutes admitting foreign students are required to submit Form-II online.

- Enrollment
- Arrival
- Departure
- Discontinuation of studies
- Other prescribed particulars relating to foreign students
The requirement applies to:
- OCI Card Holders
- Nepalese Nationals
- Other foreign nationals wherever applicable
Legal Provisions and Penalties
The advisory warns that failure to submit Form-III (Form-C) by accommodation providers constitutes a violation of provisions relating to reporting of foreign nationals and is liable for action under the relevant provisions of the Immigration and Foreigners Act, 2025, including Section 23.
Similarly, failure to submit Form-II by Educational Institutions constitutes a violation of provisions relating to reporting of foreign students and is liable for action under the relevant provisions of the Immigration and Foreigners Act, 2025, including Section 23.
The advisory also states:
- Any person or institution furnishing false information
- Suppressing material facts
- Failing to comply with statutory requirements
shall be liable for penal action as provided under the Act and Rules.
